India's' Rohingya' Problem in Assam?

Just before midnight on New Year’s Eve, authorities in the north-east Indian state of Assam published a list of 19 million names. But not Hanif Khan’s.

Early the next morning police found Khan, a taxi driver from Cachar district, dead from an apparent suicide. “I am sure he killed himself after he found his name missing,” his wife Rushka says.

Two years ago, Assam, a lush state bordering Bhutan and Bangladesh, embarked on a vast exercise: to identify every resident who could demonstrate roots in the state before March 1971.

And deport anyone who couldn’t.

An unfinished draft was released on 31 December – minus the names of 14 million other residents. Officials have stressed the final list will include millions more names, but the process is sparking anxiety in Assam, and warnings Indiamight be about to manufacture tens of thousands of stateless people.

Khan, 40, had grown increasingly tense in the weeks leading to the publication of the draft. Though he was born in Assam to an Indian mother, his father was an Afghan national who had long since drifted home.

“He told me many times that the documents he presented to prove he was a citizen of India were perhaps not enough,” his wife said.

Assam is building a new detention centre to process the “foreigners” it plans to evict in the coming years. At least 2,000 people are already detained in six facilities across the state.


Khan often mentioned the detention centres, and had started to panic at the sight of police cars near his home, Rushka says. “He was extremely frightened. Every day he told me that police would arrest him and push him to Bangladesh.”

By December he was skipping meals and turning down driving jobs in unfamiliar places. Five hours before the list was published, his wife says, he vanished.

The eastern Indian border with Bangladesh traverses five states and more than 4,000km. For centuries until the partition of the subcontinent in 1947, human traffic flowed freely across the territory. In smaller numbers, people have continued crossing in the decades after: Indian security agencies estimate about 15 million Bangladesh citizens work and live in India without authorisation.

Just as with porous borders elsewhere, the flow of migrants from Bangladesh inflames Indian passions. Border guards were accused of gunning down nearly 1,000 people, most of them suspected smugglers, in the decade to 2010. A barbed-wire fence, bolstered in parts by floodlights and cameras, has been under construction since the mid-1980s and will eventually stretch more than 3,300km.

Resentment has been most acute in Assam, where it sparked an anti-migrant movement in the 1980s that paralysed the state and eventually won government. It also fuelled one of India’s worst single-day massacres since partition: a frenzied seven-hour pogrom in a clutch of Muslim villages that left at least 1,800 people dead.

“Here, foreigners are like people from a different planet,” says Aman Wadud, a lawyer who represents people accused of migrating illegally.

Assamese residents complain thousands of migrants have found their way onto voting rolls and take jobs and land from locals. “In the past two decades, loads of Muslims from Bangladesh have settled around us,” says Pankaj Saha, a retailer from Dhubri district.

“Twenty years ago, Hindus formed 75% of my town’s population. Today, the Muslims are in majority.”

Proving the identities of more than 30 million people – many bearing handwritten records, or none at all – has fallen to Prateek Hajela, a senior civil servant. “We have received around 65 million documents,” he says from his office in Guwahati, the Assam capital.

The fate of those who fail to win citizenship is outside his control, he says. “What happens to those people who have applied and are not found to be eligible, I can’t say.”

Yet this is the question dogging the process. Tribunals have already declared about 90,000 people in Assam to be foreigners, according to statistics obtained by IndiaSpend, a data journalism initiative.

Only a few dozen have been deported in recent years – Bangladesh and India have no formal repatriation agreement – and officials admit many turn around and return at the first opportunity.


Another 38,000 of those declared to be foreigners in Assam have disappeared into the community, according to police records. Thousands more claim to be wrongly accused and are awaiting citizenship hearings.

The prospect of being suddenly arrested as a foreigner and languishing for years in a detention camp is worrying Bengali Muslims in particular. “There is enormous fear and apprehension in the community,” Wadud says.


Other than Hanif’s, at least two others suicides have been linked to the process. “I am telling people, we need to wait for the second list,” says Subimal Bhattacharjee, an analyst who runs welfare schemes in the state. “A significant number of names will be added. Verification is still going on.”

When the government finally publishes the full list of citizens on 31 May, the ranks of foreigners in Assam could swell by tens of thousands – with no clear plan yet of what to do with them.

The Assam chief minister, Sarbananda Sonowal, said in an interview last month that foreigners would lose constitutional rights. “They will have only one right – human rights as guaranteed by the the UN that include food, shelter and clothing.”

The issue of deportation, he said, “will come later”.

Officials in the Indian home ministry declined to comment on the record but said their expectation was that Bangladesh would take back any of its citizens, as it currently does on a case-by-case basis.

Bangladesh says it is not aware of any citizens living illegally in Assam, and that India has never raised the prospect of mass deportations from the state. An official at the country’s high commission in Delhi confirmed this position was unchanged.

“Deportations will never happen,” Wadud says. “Bangladesh will never accept these people. I can’t imagine what will happen to them. They will become stateless people with no rights whatsoever.”

Mr. Apologist, excuses are not enough

It has been a fortnight of shocking tragedies in India and abroad — and of excuses by you, Mr. Apologist.

You have told me that I should not overreact: journalists get killed all over the world, and sometimes on their own doorsteps; the Rohingya are just suffering from an internal law-and-order problem; the hurricanes ravaging the Caribbean these days and the floods ravaging India are just natural phenomena, and not due to climate change; and as for the Dreamers, poised earlier to be kicked out of U.S., oh well, that’s all politics, you know, and such things happen in politics (you know). Calm down, you tell me.

Let me reassure you, I am calm. So calm that I am willing to accept all your above positions, though I disagree with them either entirely or in part. I am calm enough to concede that in holding these positions you are establishing a certain political perspective. I differ from you, but as long as you do not elaborate into a justification of murder or genocide from your preliminary positions, you have the grounds to think as you do.

Cracks in society, in humanity

But are you calm enough to realise that my main objections arise from other (related) aspects of all these cases, as elaborated by you?

Are you calm enough to concede that a brutal murder shakes the foundations of society, and its perpetrators can be allowed to go scot-free only if you want hairline cracks to develop further in your society? When the murder is that of a besieged public figure and one with whom you (Mr. Apologist) disagree, the cracks run deeper — and you owe it to your own society to hold the culprits accountable. Cracks in a society and a state often seem to remain superficial until it is too late and the entire edifice starts crumbling — as we have seen and are seeing in many countries. Are you calm enough to concede that the least you can do, out of common decency if not patriotism, is to ‘unfollow’ those of your social media ‘friends’ who justify a murder and vilify its victim?

Like you, I know — for I am not what you will call an ‘idealist’ (alas) — that states need to exercise authority, and more so when faced with insurgency and extremism. I am calm enough to say — though many leftists and Muslims will berate me for it — that the Burmese state might have needed to act against some form of Islamist insurgency. But when such actions lead to the killing of children and force more than 300,000 villagers to flee for their lives, then surely we are talking of an extreme abuse of authority, surely we are talking of genocide and ethnic cleansing? Are you calm enough to concede that we cannot justify such horrors without hairline cracks developing in our very humanity, so that one day, it too, like society or state, crumbles into dust?
Hurricane Irma or the devastating floods in Bihar, you tell me, these are natural disasters. You dismiss climate change: calm down, you tell me, Earth was even hotter thousands of years ago, when there were no polluting industries.

Dumping our refuse

But — unlike most people who are fighting to stop climate change — I am willing to concede that I can never convince you of climate change. If I point to an extreme winter this year, you will point to a moderate winter another year. Climate change cannot be proved in a laboratory: there is evidence that it is taking place, but all of it exists at a very high scientific level (for instance, projections of CO2 emissions and their effects) or at a degree of theoretical abstraction. You can always refuse to accept those conclusions. I am calm enough to accept that.

But are you calm enough to acknowledge that you do not dump your refuse — most of it biodegradable — in your own house, but we, as a species, are dumping our refuse (much of it not even biodegradable) in the only house we know, planet Earth? Are you calm enough to concede that if the former is bad for you, the latter must be bad for all of us?

As for the prospective expulsion of the Dreamers — young men and women, almost entirely educated and employed today, who grew up in the U.S. and have often known only that country, these are people whose parents entered the U.S. illegally when the Dreamers were two or ten years old and in no condition to have a say in the matter. These are people who pay extra to society for living there and who came out and disclosed their status in response to a promise by a previous government. Are you calm enough to concede that we cannot punish children for the crimes of their parents, and that people who have grown up, contributed and committed themselves to a nation have earned the right to stay there? Are you calm enough to realise that politicians cannot be allowed to arbitrarily tinker with established governmental policies affecting ordinary thousands for unclear, personal, vindictive or racist reasons?

Are you calm enough to face the fact that we owe our children much more than mere excuses, Mr. Apologist?

The Muslim Ummah have abandoned the Rohingyas

While the Rohingyas starve, live in fenced in camps or are on boats in high seas with no country willing to accommodate them the Islamic organisations are loudly quiet in their response while western human rights organisations as well as Jewish holocaust survivors espouse their cause. So what happened to the universal brotherhood of Islam? Why don't they offer refuge to their fellow brethren?

The Rohingyas were used by the British during the second world war as a fifth column to defeat the Japanese in Burma. Towards this end they were resettled in the Arakan area of Burma, given arms, money and training by the Allied forces. After the British withdrew from the area and new countries like East Pakistan was created, the Arakan province was to become a part of Burma. At this time the Rohingyas started a jihad against the Burmese government to get their territories to be a part of Jinnah's East Pakistan. Many Islamist organisations were active in this jihad.

At the time the Rohingyas used the 'dar-ul-harb' concept to refuse to integrate with the Burmese population where they were in a minority. Like their Muslim brethren in the northern plains of India they did not wish to live in a country where they were in a minority. They were actively supported in this jihad by Islamic organisations in Pakistan.

The Burmese, unlike the Indians, when they defined their citizenship laws were unwilling to accommodate this group with a separatist and jihadist motive and the Rohingyas were deemed stateless. So, from then on the only way out for the Rohingyas was to pay smugglers to get them out of the Arakan province into countries where they could lead a decent life.


So why are the Islamist countries not going the extra mile to help their brethren? Why is Pakistan (The holy land for the pure) not inviting these Rohingyas to resettle them in their lands? Why is the Islamic State not taking them to Iraq or Syria nor the al Qaeda making attempts to rescue them? Can we say that NIMBY (Not In My Backyard) supersedes the Islamic Brotherhood?

The Rohingyas - The forsaken people

Of the approximately two million Rohingya alive today, 800,000 live in Burma, 200,000 in Bangladesh, 50,000 in Malaysia and around 500,000 live scattered over the Middle East, where they went looking for work. But can the Rohingya call any of these countries their home? Their treatment by the two proposed countries of their origin – Burma and Bangladesh – does not suggest so: while one has a majority tied up in refugee camps, the other is bent upon killing them to the last man. What did the Rohingya do to deserve this fate?

History of the Rohingya People

The origins of the Rohingya people are disputed. Followers of Islam and belonging to the Indo-Aryan stock, they themselves say that they are natives of Rakhine, the south-western Burmese state which shares its northern border with Bangladesh. Others suggest that they are of Bengali origins, and that their language is a derivative of the Bengali language. Alistair D. B. Cook suggests that their movement originated in the Middle East, and brought them to Rakhine after crossing the rest of South Asia.

Whatever their origins, most scholars agree that the Rohingya have been residents of Burma since around the 15th century AD. Archaeological evidence reportedly suggests that the Rohingya have lived in the country since the times of the Kingdom of Mrauk U (1425 AD – 1785 AD). And yet the Burmese government insists that they are not one of their “historical ethnic groups”: the major reason behind their persecution at the hands of the Burmese authorities.

What did the Rohingya do to deserve this fate?

Under British rule, Bengalis were encouraged to repopulate the fertile region of Arakan (now Rakhine), and the boundaries between Bengal and Arakan were removed. So, in all practicality, Bengal and Arakan became a single state making it easier for the Bengali people – who were majority Muslims – to travel to and from Arakan. This migratory trend resumed at the time of the Bangladesh Liberation Movement in 1971, when many Bengalis fled their country and settled in Arakan, instead. The Burmese government insists that most of the people who form the Rohingya community today belong to this stock: another reason behind their attempts to expel the community from the country.

During the Second World War, Japan successfully captured Burma but the British fought the Japanese invading forces on Burmese soil. After the Japanese were ousted, Burma’s Rohingya formed a political party – Arakan Muslim League – which started a political movement to be absorbed into East Pakistan at the time of the Partition of India. The party sent a request to Mohammad Ali Jinnah, himself, in May 1946 to include Arakan in his partition plan. Jinnah turned the request down, replying that he could not intrude in Burmese affairs.

Apparently Jinnah’s rejection led the Rohingya to abandon their political cause, not seeing any use in pursuing it. They decided to take up arms, instead. The target of this armed movement, termed by the Rohingya as a jihad, was at first the separation of the Mayu region in the north of Arakan – where most of their population resided – and its annexation with East Pakistan. When the Burmese government refused to cater to these demands, the Rohingya mujahideen declared jihad on their own government. There was a time when these armed rebels controlled almost all of northern Arakan, forcing the non-Rohingya inhabitants of the state to flee their homes.

This jihadist movement continued for about a decade before the Rohingya rebels finally laid arms between 1957 and 1961, primarily as a result of a military operation initiated to crush the uprising. This is when the displacement of the Rohingya began, which continues to this day.

The Rohingya’s Current Status

After being crushed by the Burmese government in the 1960s, the Rohingya rebellion re-immerged at the time of the East Pakistani separatist movement. At the moment, it is believed to be receiving aid from Islamic terrorist groups such as Al-Qaeda and the Tehrik-i-Taliban, and even from some countries, including Pakistan.

The recently accelerated attempts of the Burmese government at the genocide and expulsion of the Rohingya people has brought the country into the international spotlight – for all the wrong reasons. The persecution of the Rohingya, especially under the nationalist, pan-Buddhist military rule (1962-2011) has had terrible repercussions for the community. General Ne Win, the first military ruler of Burma who assumed control of the country in 1962, expelled Muslims – all Muslims, not just the Rohingya – from the army, and in 1982, under a new citizenship law, the Rohingya were declared as non-nationals.

It didn’t stop with the government: Burma’s citizens – mostly Theravada Buddhists – had an equal share in victimizing the Rohingya people. It was the Buddhist monks who initiated an anti-Muslim movement in 2001, in which pamphlets like Myo Pyauk Hmar Soe Kyauk Sa Yar (“The Fear of Losing One’s Race”) were distributed in the common public. In the same year, 200 Muslims were killed and 11 mosques were burnt down by common Burmese citizens. It is said that this movement was in retaliation to the destruction of the Buddhas of Bamiyan in March, 2001 by the Taliban. The claim is very likely true, as the Burmese government brought down two mosques – Han Tha Mosque and Taungoo Railway Station Mosque – on the demands of angry Buddhist monks, who wanted to “avenge” the destruction of the Bamiyan Buddhas.

Clearly Muslims aren’t the only ones who are over-sensitive about their religion.

Since 2012, there have been repeated anti-Muslim riots in Rakhine and elsewhere in Burma that have claimed the lives of hundreds of Muslims. An anti-Muslim riot can be sparked in Burma for a reason as little as a Facebook photograph, or for no reason at all – it’s like a haystack simply waiting to catch fire.

With the state of their lives in Burma, the Rohingya Muslims have no option but to leave their home country – if they can call it that. But where would they go? At the moment, they don’t seem to care. The Rohingya are fleeing Rakhine by the boatful whenever they can, even though they know their journeys do not have any destination. Many have fled to Bangladesh, where they are being kept in refugee camps. Many have managed to make it to the Middle East and Japan, while some have even reportedly made it to Karachi. These are the lucky ones.

The unlucky ones? They are stranded mid-sea with nowhere to go. We can only imagine what the state of their lives in their native country must have been for them to rather float endlessly in the middle of salty waters with no food to eat and no water to drink.
